10 April 1748      Case of Bishop Toney and Sarah his wife against James Shasted, saying that on 10 April 1748 he said that Sarah Toney was "Thomas Lane's Whore" and that he would prove it.  Toney's claim damages of 50 pounds.

Blue Ridge Mountain also known as Blue Mountain, is the colloquial name of the western most ridge of the Blue Ridge Mountains in northern Virginia and the Eastern Panhandle of West Virginia. The Appalachian Trail traverses the entire length of the mountain along its western slope and crest.

James Shastood 150 Acre land grant (visually examined spelling) for 15 shillings (A grant is the first transfer of a piece of property from some government entity into the hands of an individual, so if your ancestor acquired land by grant or patent then he was the original private land owner. A deed, however, is the transfer of property from one individual to another, and covers pretty much all land transactions following the original grant of land.)

150 Acre land grant to James Shastood, ... at the head branches of Huffs Creek on the side of the Tobacco Row Mountain, bounded ...by Benjamin Stennet’s Pointers.... (Source: Val Burd - Albemarle County Order Book 1744-1748, Page 290 Surveys by Joshua Fry, have copy of grant) At the start of the 18th Century, Virginia shifted from the headrights system and allowed individuals to purchase 50 acres for 5 shillings, substantially reducing the price of Virginia land (Abernethy, p. 39 Also, John Fontaine reported in 1715 that Robert Beverley was trying to sell him 100 acres near the Falls of the Rappahannock River for 7 pounds, 10 shillings. He also offered a 500 acre tract on the Rappahannock, at 15 pounds per hundred acres. The price was higher because 100 acres was already cleared, and the land was waterfront property with a creek deep enough to be navigable. RDS Com: St. James Southam Parish has served Goochland, Cumberland, and Powhatan counties. Tar Wallett Church, a church on James River, South Chapel, Ham Chapel, and Peterville Church all fell within the bounds of this parish.

Source: Kim Shasteen – Detail souce: Val Burd: - Transcription from the Davis book.  I found two other deeds mentioning Anthony Hoggatt, but not Nathaniel Chastain.  There is a William Gray also mentioned who lived adjoining and that may be the Gray whose name is missing.  John Bostick purchased around 2,000 acres of land between June 1745 and June 1746 according to an Albemarle survey report by Joshua Fry, gentleman, surveyor for the county.

The 1751 deed to William Cabell says Jas. Sharsted. This is on page 24 of Davis "The Deeds of Amherst County, Virginia, 1761-1807 and Albermarle County, Virginia, 1748-1763." This may be the land grant land above dated 1 Apr 1749

Why Jr here and not on 1749 land grant? New son? Of age?

(11-7-94) Huff's Creek branches East side of Tobacco Row Mountains - this creek drains into the Buffalo River which is possibly the land referred to in the 1748 deed above. (This is about 5 mi N NW from present day city of Amherst). Property could be as close as 12-15 miles to the Otter Creek property sold later in 1812/1832. Perhaps this James retained part of the land, continued living there, untaxed, until 1791 & 1792 when taxed as "Buff'" Could then have turned 65 (1748 deed witness - 21 years = born circa 1727 + 65 = 1792) and become exempt? 100 A bought 1799 by James Jr. & Phoebee to sell in 1812. Let Grandson Robert farm in 1804-1806, then Senior sold 1812 but not recorded until 1832 as result of lawsuit after James Sr. deceased. How did all 230 acres wind up on both sides of Otter creek, which appears to be near James River on west side of Tobacco Row Mountains? JAMES SHARSTED, Jr. - Albemarle County, Virginia Deed Book 1 page 361. James Sharsted, Jr. in 1751, sold 150 acres of land to William Cabell. The land was located on branches of Huff’s Creek on the east side of the Tobacco Row Mountains adjacant to Benjamin Stennnets and Wm Cabell. Witnessed by James Freeland, James Christian and Philip Davis. Readers will see in the data under Amherst County that the name James Sharsted is most likely meant to be Shasteen and possibly can see a connection regarding the acreage and location of the land. See 1811 Guardianship Amherst Co.doc file. Most viable assumption James b 1786 guardian for mother Phoebe (Patsey?) to be able to sell land, altho father James b 1755-60 believed to still be alive and in 14 Sept 1812 sale, so perhaps for minor or James Sr b est 1727 spouse

Patsey could be Martha

(11-2-94, copied) Purpose of document not clear & definitive. No mention made of minor so assume for elderly or widowed Patsey (common nickname for Martha, Matilda, Patricia) Chaskin (Shasteen), who may have been Phoebe (James wife), James Sr’s wife after his death, or someone else. Signed (not really signed, stated signed and sealed & ck’d) by James Shasteen, Patsey Shasteen and Abner Padgett so assume Patsey was not a minor, nor so infirm as to require a guardian. May be more like a modern day power of attorney given by a widow to her son so he can transact her business. This would fit if this is James Sr widow (Patsey), James Jr and Robert were going to be disposing of parent’s property. Abner Padgett involvement as brother or father to Patsey? Assume all Chaskey, Chaskin, Chaskan spellings refer to Shasteen as “signed”, but could be other relation to Padgett or for that matter a Caskey.

At this point in time James b 1755-60 father of the brothers would be the Sen. No mention of Phoebe and this ties into the sale of 130 acres in 1812.

Plus in 1832 if Sr had no living children grandchildren other than via James m Phoebe, their children would be heirs at law of Sr thru Jr.

70£ in 1800 would be about $7000 today, or about $55 per acre. Would be interesting to know what VA farmland in this area is going for today

(11-15-94 copied, illegible) Recording of this deed by Court in 1832 as result of suit by Richard S. Ellis surviving partner of the late mercantile concern of John & Richard S. Ellis plaintiff against William Davis and Robert Shastead, William Shastead, Edmund Shastead, Francis Shastead and Elizabeth Shastead, heirs at law of James Shastead dec'd, defendants. (Why not James b 1785? dead 1828-30 And does this mean these were alive in 1832 Robert James John dead by 1832?

Descript: on both sides of Otter Creek and the mill and all the premises belonging to the said land. The land adjoins the lines of WmDavis, Henry S Davies, decd and Robert Knuckles Sr for and in consideration of the sum of sevent pounds, the fee simple title..... Possession 1 Oct 1812 with privilege to seed this fall and make any buildings at any time forthwith, all the premises are to be well taken care of...Teste: Bennett Tinsley, Sandon Tuley, Linza Burks.

Note that both this property and the 100 A sold above were on the lines of Wm Davis and Robert Knuckles confirming the land was together and meaning that the two James' had at least about 230 acres together on Otter Creek in SW Amherst County probably very near the James River to have a mill but we only have purchase of 60 and 100.

Note: The mill may have been a grist mill or saw mill or both. Reading about mills, a merchant mill is the outgrowth of a small area mill for grain, with more expensive equipment, and many early merchant mills were next to sawmills owned by the same merchant. Would suspect this is a small grist mill for wheat as the will included provision to “seed this fall”

Circuit Sup court: Ellis vs Davis and Robert, William, Edmund, Francis, and Elizabeth Shastead heirs at law of James Shastead decd

Appears to be suit to clarify sale in 1812 that had not been booked, no indication of who the heirs at law were. Shastead not of this county and they did not appear. Contract from James Shastead to firm seems valid and good, but not recorded. The 15 May 1812 land sale of 130 A by James Shastead Sen to John & R S Ellis and 14 Sep 1812 land sale of 100 A by James Shartead Jr and wife Phoebe to same appears to be clarified for inheritance purposes for the Ellis family et al in the 12 Sep 1832 suit by Richard S. Ellis surviving partner of the late mercantile concern of John & Richard S. Ellis plantiff against William Davis and Robert Shastead, William Shastead, Edmund Shastead, Francis (DIL?) Shastead and Elizabeth Shastead, heirs at law of James Shastead dec'd, defendants.
